Dispute referrals & introduction fee
How our adjudication & arbitration referral service works.
1. What this service is
VariationFlow can introduce you to an independent third-party provider of construction dispute-resolution services — adjudication (a fast, statutory process under the Housing Grants, Construction and Regeneration Act 1996) or arbitration. With your consent, we assemble an evidence bundle from the records you already hold in VariationFlow and hand it to the provider.
VariationFlow is not a law firm, adjudicator, arbitrator or claims-management company, and does not provide advice on the merits of your dispute. The dispute-resolution service itself is provided by the independent third party, under their own terms.
2. The introduction fee
If you proceed with a referral, VariationFlow receives an introduction fee of 3% of the provider’s professional fee, paid to us by the provider.
The fee is calculated only on the provider’s professional fee. It is not a percentage of the amount you claim, of any amount awarded, or of any amount you recover. It is not added to your costs — you pay the provider their fees on their own terms, exactly as if you had approached them directly.
Because our fee is an introduction fee on the provider’s charges — and never a share of the outcome — VariationFlow has no financial interest in the result of your dispute.
3. Independence of the adjudicator or arbitrator
The independence and impartiality of the appointed adjudicator or arbitrator is fundamental. VariationFlow does not select or influence which individual is appointed — that is a matter for the provider or the relevant nominating body. Our introduction fee does not affect, and must not be taken to affect, that independence.
We disclose this arrangement to you before any referral is sent, and a record of that disclosure and your acceptance is stored with the referral and reproduced in the evidence bundle, so the arrangement is transparent to all parties.
4. Your data and consent
A referral shares dispute-related records with the third-party provider — for example the variation in dispute, contract notices, payment and notified-sum history, evidence items and the audit trail. This only happens when a member of your organisation with the appropriate role explicitly submits a referral and accepts this disclosure.
The provider processes that information as an independent controller under their own privacy terms.

5. No obligation
Using the referral feature is entirely optional. You are always free to instruct any adjudicator, arbitrator, nominating body or adviser of your own choosing, independently of VariationFlow, and to refer a dispute yourself at any time.
